Terms of service

Éclat Désirs is a Private Luxury Gifting & Patronage Platform. It is NOT an escort service, a dating service, an adult content platform or a money transmission service. Muses curate their desires and Patrons may voluntarily celebrate and support them through gifts and patronage where Muses curate their desires and Patrons may voluntarily celebrate and support them through gifts and patronage. We are not a retailer, an escort or dating service, an adult-content platform or a marketplace for personal services: we do not sell, stock or import the pieces shown, and each item links to the house or boutique that offers it.

All gifts and patronage are voluntary. They do not constitute payment for any service provided by a Muse, and a Patron acquires no contractual right to a Muse's time, attention, communication, companionship or personal interaction. Gifts and patronage never create an obligation to provide dates, meetings, intimacy, sexual activity, sexual content, photographs, videos, companionship or any other personal service. A Muse is never required to meet, communicate with or otherwise interact with a Patron as consideration for receiving a gift or patronage. Patrons must not condition financial support on receiving sexual, romantic, intimate or personal services, and Muses must not offer sexual, escort, intimate or compensated dating services through Éclat Désirs. Éclat Désirs facilitates voluntary gifting and patronage only and does not guarantee gifts, patronage, relationships or interactions between members. Violations may result in restriction, suspension or termination of the account.

Every gift and contribution is a voluntary, personal transfer from a Patron to a Muse. It creates no obligation, service, entitlement or expectation of any kind in return. A gift is final once made and cannot be reversed by the Patron.

Several Patrons may contribute towards a single desire. Once a desire is fully funded it is marked fulfilled. Free contributions are credited to the Muse's account balance and may be used at her discretion, including towards a different desire. Amounts are shown in the currency selected at checkout.

A Patron is only ever charged the amount shown at confirmation — the chosen monthly membership or gift amount. Nothing is added on top. Any service retention is settled internally on the Muse payout side and never appears in a Patron's checkout, account or receipt. Founder accounts are exempt from any retention.

Payments are handled by our payment provider. We never store full card details. A payment is authorised at the moment of confirmation; if it fails or is later reversed, the associated gift or contribution is cancelled.

Muse plans (FREE, AMORE and ÉLITE) and recurring Patron circles bill in advance on a monthly cycle and renew automatically until cancelled. You may cancel at any time from your account; access continues to the end of the paid period. Membership fees are separate from gifts and are not transferred to a Muse.

Gifts and contributions are non-refundable once processed, as they are voluntary transfers. Membership fees already billed are non-refundable, though you may cancel future renewals at any time. Where a payment was made in error or without authorisation, contact the concierge desk and we will review it.

A Muse's address is never shown to a Patron. Physical gifts are routed through the Éclat Concierge relay with a per-wish reference code. Delivery timelines depend on the house or boutique fulfilling the order, and we cannot guarantee stock, pricing or shipping windows set by third parties.

You must be at least 18 and provide accurate information. Harassment, coercion, solicitation, adult services, impersonation, illegal goods and any attempt to obtain another member's private details are prohibited and may lead to immediate removal.

FREE (€0) — up to 5 wishes, private sharing links, no gifts, no patronage, no Privileges. AMORE (€19 per month) — up to 20 wishes, gifts and patronage, standard Concierge, no Privileges. ÉLITE (€39 per month) — unlimited wishes, gifts and patronage, Privileges access and priority Concierge. Subscriptions are paid directly to Éclat Désirs and renew monthly until cancelled.

Gifts and patronage are currently in preparation and will be available soon. Muse memberships are available now. Until gifting opens, no gift or patronage payment can be made on the platform.

A platform service fee of 15% is retained on all gift and patronage transactions once these features are available. Membership subscriptions are paid directly to Éclat Désirs and carry no additional fee.

The following are prohibited and lead to immediate termination: soliciting or offering any service, meeting, companionship, intimacy or content in exchange for gifts or patronage; adult, sexual or explicit content of any kind; harassment, coercion or pressure of any member; misrepresentation of identity, age or circumstances; illegal goods, fraud, money laundering or any attempt to use the platform as a money transmission service.

Every profile, wishlist and message carries a reporting function. Reports are reviewed by the house and may result in warning, restriction, suspension or immediate termination without refund. We may also terminate an account where required by our payment providers or by law.

Card payments are processed by our payment providers. Éclat Désirs never stores full card details and never holds member funds as a money transmitter. Statements show ECLAT DESIRS.

Gifts may be treated differently depending on where you live. See Legal & tax for jurisdictional notes. Each member is responsible for their own tax position; Éclat Désirs does not provide tax advice.

The platform is provided as-is. We are not responsible for the quality, authenticity or availability of goods and services offered by third parties. We may update these terms; material changes will be announced, and continued use constitutes acceptance.

These terms are governed by Swiss law. The exclusive place of jurisdiction is Switzerland, and the competent Swiss courts shall settle any dispute arising from or in connection with the use of Éclat Désirs.
